Aussie Painting terms

Plain-English terms for every job we do. They sit behind your written quote. If anything here is unclear, ask us before you accept the quote.

1. Who we are and how these terms work

These are the terms Aussie Painting works on. When you accept our quote (by signing it, replying yes by text or email, paying the deposit, or asking us to start), you agree to the quote and to these terms. The job is what the quote says in writing. If we told you something that matters to you and it isn't written in the quote, tell us before you accept, so we can add it.

If the quote and these terms say different things about the job itself (the surfaces, the preparation, the price or the timing), the quote wins, because it was written for your job. The guarantee is different: its terms are the ones in our guarantee document (section 11). A quote can leave a surface out of the guarantee, or give different guarantee terms for particular work, only where it says so in writing. Where a quote, an invoice or a message mentions the guarantee in a few words, it means the guarantee document.

"We" and "us" mean Aussie Painting. "You" means the person or business that accepted the quote. If you are arranging the work for someone else (as a tenant, agent, property manager or owners corporation), you confirm you have the owner's permission for it.

2. Quotes and what the job covers

We look at the job in person and give you a free, written quote. The quote lists the areas to be painted, the preparation, the price including GST, the expected timing, the deposit and the payment terms. If it isn't in the quote, it isn't part of the job.

A quote stays open for 30 days unless it says otherwise. After that we may need to look again, because surfaces and paint prices change.

The instant estimate on our website is a guide only. The written quote we give after seeing the job is the price.

This is an agreement for painting only. It covers preparing the existing surfaces for paint (washing, scraping, sanding, filling small holes, cracks and gaps, priming and sealing) and applying the paint. We are not builders. We don't do plastering, rendering, carpentry, replacing weatherboards or other timber, glazing, roofing, plumbing, electrical or any other building work, and we don't arrange, manage or supervise other trades. If your job needs one, you engage and pay that trade yourself, under your own agreement with them, before we paint.

The quote describes the work: the surfaces, the preparation, the number of coats and the type of paint. It isn't a promise of a particular result beyond that, such as how many years the paint will last or that it will stop damp or mould.

We don't remove lead paint, and we don't prepare or paint old fibro (asbestos cement sheet). If either turns up once work has started, we stop work on that part and tell you. Testing and any specialist work are for you to arrange, and section 3 applies to what happens next.

3. Changes to the job (variations)

If you want something added, removed or changed, or we find something that couldn't reasonably be seen when we quoted (rot or rust under old paint, damp, earlier coats that won't hold, extra coats needed over a strong colour), we stop and show you. We agree the change and its price in writing before doing it. A text or an email counts as writing.

When we find a problem with a surface, or recommend more preparation than the quote allows for, we stop work on that area and tell you in writing, with photos and a price where we can do it. You then choose, in writing: add it to the job, have it fixed by a trade you engage yourself, or have us paint the area as it is. If you choose to paint it as it is, we'll do that, but our guarantee doesn't cover that area (section 11), and we'll note it on the job record.

We don't charge for extra work you haven't agreed to. If we can't agree on a change that the job needs to be done properly, either of us can end the job under section 9.

4. Payment

The deposit only covers the materials for your job. The quote sets the deposit and when the rest is due. All our prices include GST.

Please pay each invoice by the date on it. If a payment is overdue we may pause the work until it is paid, and the finish date moves by the same time. If an invoice stays unpaid after a reminder, we may recover it as a debt, together with our reasonable costs of recovering it.

If you think something is unfinished or not right, tell us straight away and we'll come and look (section 10). Please don't hold back the whole payment over a small item: pay the part that isn't in question.

5. Access and getting the site ready

On the agreed days we need clear, safe access to the areas being painted, plus water, power and somewhere to park. For high walls our painters may work from a lift such as a cherry picker, which needs firm, clear ground to stand on.

Before we start, please move small, fragile and valuable items out of the rooms being painted, take down pictures and curtains, and keep children and pets away from the work and from wet paint. Tell us at the quote if anything heavy needs moving so it can be planned.

If we arrive on an agreed day and can't get in or can't safely work, we'll reschedule. Any direct cost that causes us (for example a lift hired for that day) is passed on to you at cost.

You need to tell us about anything we couldn't know by looking: leaks, damp, past repairs, alarms, fragile surfaces, and any owners corporation, heritage or council rule about colours or working hours. Approvals and permits for colours are yours to obtain.

6. The condition of your property before we start

Paint is a coating. It doesn't fix what is underneath it. Problems that were already in the property are not caused by our work, and fixing them isn't part of the job: rot, rust, damp, leaks, cracks, movement in the building, loose or drummy plaster or render, and earlier coats of paint that are failing. When we can see one of these, at the quote or once work starts, we tell you in writing before we paint that area, and you choose what happens next (section 3). Problems nobody could see can still show up later and affect the new paint. That isn't a fault in our work.

Your quote notes the problems we could see when we looked, and which areas, if any, our guarantee won't cover because of them. Please read those notes before you accept. We also take dated photos of the surfaces before, during and after the work, and may take moisture readings on timber. Those records show the condition of the property and the preparation that was done, and we use them if there's ever a question.

Dents, ripples, patches and old repairs in a surface can still show through new paint, and fresh paint can make some of them easier to see. The preparation in your quote sets the standard of finish. If you want a higher standard, ask us to quote the extra preparation.

We take reasonable care of your property. If we or our painters damage something by not taking reasonable care, we'll put it right. Tell us as soon as you notice.

7. Colours

You choose the colours and confirm them in writing before we buy the paint. Colours look different on a screen, on a chart, in a sample pot and on a whole wall, and they change with the light and the sheen. We recommend a sample patch on the actual surface before you decide.

Dark colours in full sun get very hot. On timber and over old paint that heat can cause blistering, cracking, resin bleed and early fading, however well the work is done. If the colour you choose is one of these, we tell you in writing before we buy the paint, and that heat damage isn't covered by our guarantee (section 11).

Tinted paint can't be returned. A change of colour after the paint has been bought, or after painting has started, is a variation under section 3.

We can't promise an exact match to existing paint. Paint fades and batches differ, so a touch-up over old paint may show. Where a match matters, the usual answer is to repaint the whole wall or section.

8. Timing, weather and delays

Start and finish dates are an estimate, not a promise. Outside work depends on the weather: we don't start exterior work when rain or heavy dew is due, and on hot days the crew works in the shade, because paint applied in the wrong conditions fails early.

We aren't responsible for delay caused by weather, by other trades, by changes to the job, by late payment, by not being able to get in, by supply problems with materials, or by anything else outside our reasonable control. We'll tell you as soon as we know and agree new dates with you.

9. Cancelling or ending the job

Before we start: you can cancel at any time by telling us in writing. We'll refund your deposit, less the cost of any materials already bought for your job that can't be returned (tinted paint, for example). Those materials are yours to keep.

After we've started: either of us can end the job by telling the other in writing if the other side has seriously failed to do what these terms require and hasn't fixed it within a reasonable time of being asked, or if a variation the job needs can't be agreed. We may also stop if the site isn't safe, or if lead paint or asbestos is found. You then pay for the work done and the materials bought up to that day, and we refund anything you've paid beyond that.

If we came to you first without being invited (for example we knocked on your door or phoned you) and we talked about the job at your home or by phone, you have 10 business days to change your mind for any reason, at no cost. That is so even if all you did at the door was agree to a quote, and even if you said yes later by text or email. For these jobs we use a separate written agreement that you sign, with the cooling-off notice on the front and a cancellation form attached, and we leave a copy with you. We don't start work or take any money, deposit included, until the 10 business days are over.

10. Checking the finished job

When the job is finished we walk through it with you, fix anything on the list that is our responsibility, and ask you to confirm in writing (a text is fine) that you're happy with how it looks. Tell us at the walk-through, or within 7 days, about anything you think isn't right with the look of the finish, while we're still set up for your job. After that we treat the look of the finish as accepted. Faults that couldn't be seen at the time are what the guarantee (section 11) and the law are for, and this doesn't take away any right the law gives you.

Painted surfaces are judged the way the Victorian building industry's guide to standards and tolerances judges them: from a normal viewing position about 1.5 metres or more away, in normal even light, not up close, under a torch or in light shining along the wall.

11. Our workmanship guarantee

Our workmanship guarantee is set out in full in a separate document, the Aussie Painting Workmanship Guarantee. We give it to you with your quote, and it is part of these terms.

In short: 7 years on eligible interior walls and ceilings, 12 months on other eligible painted surfaces, and no fixed period on decks, floors, paths, stains, oils, clear finishes and the other surfaces it lists. It covers peeling, flaking or blistering of paint we applied, to the extent caused by defective preparation or application by us. The conditions, the exclusions and how to claim are in the guarantee document. If this summary and that document differ, the document applies.

Nothing in the guarantee limits your rights under the Australian Consumer Law (section 12).

12. Your rights under the Australian Consumer Law

Nothing in these terms takes away, limits or changes any right you have under the Australian Consumer Law or any other law that can't be excluded. If any part of these terms seems to, that part gives way and the law applies.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

You are also entitled to choose a refund or replacement for major failures with goods.

If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

13. What we're responsible for, and the limits

We're responsible for doing the work with due care and skill, and for damage caused by us or our painters not taking reasonable care. We hold public liability insurance and will show you the certificate if you ask.

Subject to section 12, and as far as the law allows:

Each of us must take reasonable steps to keep any loss as small as possible.

14. Who does the work

The painting is done by qualified painters. They may be our employees or subcontractors we engage. Either way, we choose them, we direct the work, and we stay responsible to you for it under these terms.

15. Photos and privacy

We may take photos of the work for our job records. We only show photos of your property publicly (on our website, Google profile or social pages) if you've said that's OK, and never with a house number, street sign, face or number plate showing. How we handle your details is set out in our privacy policy.

16. Problems, disputes and the law that applies

If something isn't right, tell us first and give us a fair chance to fix it. Most things are sorted with a phone call and a visit. If we can't agree, either of us can take it to Consumer Affairs Victoria or the Victorian Civil and Administrative Tribunal (VCAT).

These terms are governed by the law of Victoria, Australia, and the courts and tribunals of Victoria deal with any dispute. If a court finds part of these terms can't be enforced, the rest still applies.

We may update these terms from time to time. The version that applies to your job is the dated copy we sent you with your quote. We keep a copy of it with your job record.
