Aussie Painting Workmanship Guarantee

This document sets out the terms of the voluntary Aussie Painting Workmanship Guarantee.

This guarantee is an additional voluntary promise made by Aussie Painting.

It does not replace, restrict, exclude or modify any consumer guarantee, implied warranty, right or remedy that cannot lawfully be excluded under the Australian Consumer Law, Victorian law or any other applicable law.

1. What we are guaranteeing

Aussie Painting guarantees the workmanship involved in the preparation and application of paint to eligible surfaces covered by this guarantee.

This is a workmanship guarantee only.

It is not a guarantee that:

A claim under this voluntary guarantee is covered only where a Covered Failure is caused by defective preparation or defective paint application performed by Aussie Painting or a person engaged by Aussie Painting to perform the relevant work.

Part A: 7-year interior wall and ceiling workmanship guarantee

2. What receives the 7-year guarantee

The voluntary 7-Year Workmanship Guarantee applies only to eligible interior painted walls and interior painted ceilings.

For work to qualify for the 7-year guarantee, all of the following must apply:

Interior wall

An interior wall means the principal vertical painted face of a wall located inside the building.

Interior ceiling

An interior ceiling means the principal painted face of an internal ceiling.

Components attached to, surrounding or adjoining a wall or ceiling are not automatically included simply because they form part of the same room.

3. What the 7-year guarantee does not cover

The 7-Year Workmanship Guarantee does not apply to:

Some of those surfaces may receive the separate 12-month workmanship guarantee in Part B.

Their exclusion from the 7-Year Workmanship Guarantee does not affect any rights or remedies that cannot lawfully be excluded.

Part B: 12-month limited workmanship guarantee

4. Other eligible painted surfaces

Subject to the exclusions in this document, Aussie Painting provides a 12-month limited workmanship guarantee on other eligible painted surfaces specifically included in the accepted quote.

This may include eligible:

where Aussie Painting performed the agreed preparation and painting system.

The 12-month period begins on the completion date for the relevant work.

The shorter period reflects the substantially greater effect that weather, sunlight, moisture, temperature, movement, handling, wear and environmental exposure can have on these surfaces.

5. Surfaces receiving no fixed-period voluntary guarantee

Unless the accepted quote expressly states otherwise, Aussie Painting does not provide a separate fixed-period voluntary workmanship guarantee for:

This does not exclude any statutory right or remedy that applies independently of this voluntary guarantee.

Part C: What counts as a Covered Failure

6. Covered Failures

For either the 7-year or 12-month voluntary guarantee, a Covered Failure means:

peeling, flaking or blistering of paint applied by Aussie Painting, to the extent directly caused by defective surface preparation or defective paint application performed as part of the Covered Work.

Defective workmanship means workmanship that did not meet the standard reasonably expected of competent painting workmanship for the relevant surface, scope and coating system.

The existence of peeling, flaking or blistering does not by itself establish that Aussie Painting's workmanship was defective.

Paint can peel, flake or blister for many reasons unrelated to painting workmanship.

The cause of the failure therefore determines whether the voluntary guarantee applies.

7. Things that are not Covered Failures

The voluntary guarantee does not cover:

Part D: Existing surfaces and hidden problems

8. Existing coatings

Unless the accepted quote expressly includes stripping a surface back to the bare substrate, Aussie Painting is not agreeing to remove every existing layer of paint or coating.

Existing coatings that reasonably appear suitable to remain may be prepared and painted over.

Older coatings can contain hidden weaknesses that are not reasonably discoverable without removing otherwise apparently sound material.

Where an old coating or underlying layer later loses adhesion and causes Aussie Painting's coating to come away with it, that failure is not covered by this voluntary guarantee to the extent the underlying coating failure caused or contributed to the problem.

Aussie Painting does not guarantee the continuing integrity of coatings it did not originally apply.

9. Hidden and pre-existing property conditions

Aussie Painting will exercise reasonable care and skill when assessing and preparing surfaces.

However, painting work is not a:

Unless specifically included in the accepted quote, Aussie Painting is not undertaking to:

A failure is not covered under the voluntary guarantee to the extent it is caused or contributed to by a latent, concealed or underlying condition that was not reasonably discoverable during the ordinary non-destructive assessment and preparation reasonably expected for the painting work.

10. Problems we identify before or during the job

If Aussie Painting identifies a condition that may materially affect paint performance, Aussie Painting may:

If the customer chooses not to undertake recommended preparation or remedial work, Aussie Painting may proceed only if reasonably appropriate to do so.

Where that happens, the affected surface may be identified in writing as excluded from this voluntary guarantee.

If the declined work later causes or contributes to a failure, that failure is not covered by the voluntary guarantee to that extent.

A text message, email, quote, variation, job note or other written communication may record such an exclusion.

Part E: Excluded causes

11. Underlying surface and building failures

The voluntary guarantee does not apply to the extent a failure is caused or contributed to by:

Part F: Limited-scope and customer-requested work

16. Limited preparation

The voluntary guarantee does not apply to an affected area where:

17. Customer-supplied products

Where the customer supplies paint or another coating product, Aussie Painting does not provide a voluntary guarantee regarding:

Aussie Painting remains responsible for its own workmanship to the extent required by law.

18. Products or colours used against our advice

If Aussie Painting advises in writing that a particular product, coating system, colour or application may create an increased risk of failure or deterioration and the customer instructs Aussie Painting to proceed regardless, the voluntary guarantee does not cover a resulting failure to the extent that the advised risk caused or contributed to it.

19. Touch-ups and freshen-ups

Unless expressly included in the accepted quote as Covered Work, the voluntary guarantee does not apply to:

Part G: Customer obligations

20. Reasonable maintenance

The customer must take reasonable steps to maintain the property and avoid preventable paint deterioration.

For interior walls and ceilings, this includes where relevant:

Failure to do these things does not automatically cancel the entire voluntary guarantee.

However, the guarantee does not cover a failure to the extent the customer's lack of reasonable maintenance caused or materially contributed to it.

Part H: When the guarantee runs

21. Start date

The applicable voluntary guarantee begins on the completion date recorded on Aussie Painting's final invoice or other completion record.

The periods are:

Any surface specifically excluded from the voluntary guarantee receives no fixed voluntary warranty period.

22. Payment

Eligibility to obtain remedies under this voluntary guarantee is conditional upon all amounts properly due and not genuinely disputed under the relevant contract having been paid in full.

This condition applies only to Aussie Painting's additional voluntary guarantee.

It does not affect statutory rights that cannot lawfully be excluded.

23. Warranty repairs do not restart the clock

Rectification performed under this voluntary guarantee does not create a new guarantee period.

The repaired area remains covered only for the unexpired balance of the original applicable guarantee period.

24. Transfer of the voluntary guarantee

The voluntary guarantee is provided to the customer identified in the accepted quote or invoice in relation to the property identified in that document.

The voluntary guarantee is personal to that customer and does not automatically transfer if the property is sold or transferred.

Aussie Painting may agree to a transfer in writing at its discretion.

This clause applies only to this voluntary guarantee and does not restrict any independent right, statutory warranty or consumer guarantee that a later owner may have under applicable law.

Part I: Making a claim

25. Tell us promptly

A customer should notify Aussie Painting in writing as soon as reasonably practicable after becoming aware of an alleged failure.

We ask that customers notify us preferably within 30 days of first noticing the problem.

Late notification does not automatically extinguish rights under this voluntary guarantee.

However, additional deterioration, damage or rectification cost caused or increased by unreasonable delay is not covered by the voluntary guarantee to that extent.

The customer must take reasonable steps to prevent avoidable further damage.

26. Information we need

A claim should include, where reasonably available:

The customer does not need the original paper invoice if Aussie Painting can otherwise reasonably identify the job.

27. How we assess a claim

Aussie Painting may initially assess a claim using photographs, video, original job records, preparation and progress photographs, product information, subcontractor records, variations, completion records, maintenance information, manufacturer information and any other reasonably relevant evidence.

A physical site visit is not automatically required for every claim.

Where the available information clearly establishes that:

Aussie Painting may advise the customer that the claim is not covered without first attending the property.

Aussie Painting will explain the reason for that decision.

Where the cause of the alleged failure is genuinely uncertain or materially disputed and cannot reasonably be determined from the available information, Aussie Painting will be given a reasonable opportunity to inspect the affected area before finally determining whether the claim is accepted under this voluntary guarantee.

An inspection may include photographs, moisture readings, adhesion testing, examination of coating layers, small test areas or other reasonable assessment methods.

Aussie Painting may also obtain information or advice from the paint manufacturer, an independent painter, coating specialist, building professional or other appropriately qualified person.

Aussie Painting's assessment under this voluntary guarantee does not prevent the customer from disputing the assessment, obtaining independent advice or exercising any right available under applicable law.

28. Inspection

Where reasonably required, an inspection may include:

The customer must provide reasonable access to the affected area.

Unless otherwise agreed, access should be available during normal weekday working hours.

Part J: Do not remove the evidence first

29. Aussie Painting must have a reasonable opportunity to inspect

Before Aussie Painting has had a reasonable opportunity to assess the alleged failure, the customer should not have the affected area:

If the affected area is materially altered before Aussie Painting has had a reasonable opportunity to assess it and this prevents the cause from being reliably determined, Aussie Painting may decline the voluntary guarantee claim to the extent that the alteration prevents reasonable assessment.

This does not apply where urgent action was reasonably necessary to:

Where reasonably practicable, photographs should be taken before urgent work is undertaken.

Part K: How a valid claim is fixed

30. Aussie Painting has the first opportunity to rectify

Where a voluntary guarantee claim is accepted, Aussie Painting has the first reasonable opportunity to arrange and perform the rectification.

Aussie Painting may arrange for the work to be performed by:

The customer does not have an automatic entitlement under this voluntary guarantee to hire another painter or contractor and require Aussie Painting to reimburse that person's invoice.

Third-party work must be authorised by Aussie Painting in writing unless applicable law provides otherwise.

31. What we actually repair

For an accepted voluntary guarantee claim, Aussie Painting will rectify the portion of the Covered Work reasonably necessary to remedy the Covered Failure.

This may include preparation and repainting of the failed area and, where reasonably necessary for an appropriate repair, extending the work to the nearest reasonable natural break.

A natural break may include:

A localised failure does not automatically entitle the customer under this voluntary guarantee to repainting of an entire wall, ceiling, room, floor, level, elevation, building or property.

Only the work reasonably required to rectify the Covered Failure is included, subject to any greater remedy required by applicable law.

32. Colour and sheen matching

Paint naturally changes with:

Paint formulations and product ranges can also change or be discontinued.

Where rectification is required, Aussie Painting may use:

The voluntary guarantee does not promise that repaired paint will be an exact invisible match to surrounding aged paint.

A difference in colour, sheen, gloss, texture or appearance caused by the age or condition of surrounding paint is not itself a Covered Failure.

33. Timing of repairs

Accepted rectification work will be scheduled within a reasonable time having regard to:

Part L: What the voluntary remedy does not automatically include

34. Primary remedy

The primary remedy provided by this voluntary guarantee is rectification of the affected Covered Work.

The voluntary guarantee does not create an automatic entitlement to:

This clause relates only to the additional voluntary guarantee.

It does not exclude compensation or another remedy that the customer is entitled to under applicable law.

If rectification cannot reasonably be performed, Aussie Painting will provide any alternative remedy required by applicable law or otherwise agreed by the parties in writing.

Part M: Cost of making a claim

35. Claim expenses

There is no fee to submit a voluntary guarantee claim.

The customer bears their own ordinary incidental expenses associated with making a claim, such as:

Aussie Painting bears the cost of an inspection or expert assessment that Aussie Painting itself chooses to commission.

If the customer independently engages:

without Aussie Painting's prior written agreement, the customer is responsible for that cost under this voluntary guarantee unless reimbursement is provided for in clause 38 or is otherwise required by law.

For an accepted claim, Aussie Painting bears the reasonable cost of the labour, paint and materials for the rectification Aussie Painting authorises and arranges.

If a physical inspection is needed and the problem turns out not to be Aussie Painting's responsibility, under this voluntary guarantee or under the law, Aussie Painting charges a call-out fee of $250 for the visit. We tell you before we book the inspection. Submitting a claim is still free, and if independent advice later shows the problem was covered, we give the fee back.

Part N: Subcontractors

36. Who may perform the work

Aussie Painting may perform painting work using employees or independent subcontractors engaged by Aussie Painting.

Aussie Painting's use of an independent subcontractor does not remove Aussie Painting's obligations to the customer under this voluntary guarantee or applicable law.

Aussie Painting may choose who performs warranty rectification.

The customer does not have a right under this voluntary guarantee to require a particular painter or subcontractor to attend.

Part O: Manufacturer warranties

37. Paint manufacturer guarantees

Paint and coating manufacturers may provide their own product warranties or guarantees.

Any manufacturer warranty is provided by the relevant manufacturer and is subject to that manufacturer's own:

Aussie Painting does not adopt a manufacturer's guarantee as an Aussie Painting guarantee merely because Aussie Painting supplied or applied that manufacturer's product.

Where reasonably appropriate, Aussie Painting may assist the customer by providing relevant product or job information for a genuine manufacturer claim.

Part P: Disputed claims

38. If we disagree about the cause

If Aussie Painting and the customer disagree about whether a failure is covered after Aussie Painting has reasonably assessed the claim, either party may request an independent inspection by an appropriately qualified painting or coatings inspector.

Where possible, the parties will first try to agree on the inspector.

The party requesting the independent inspection will ordinarily pay the inspector's fee upfront.

If the customer requested and paid for the inspection and the independent report reasonably concludes that the failure is covered by this voluntary guarantee, Aussie Painting will reimburse the reasonable inspection fee and carry out the applicable rectification.

If the report concludes that the failure is not covered by this voluntary guarantee, the customer remains responsible for the inspection fee they incurred.

If Aussie Painting requests the independent inspection, Aussie Painting will pay the inspector's fee.

The independent report may be considered together with all other relevant evidence. Unless the parties separately agree in writing, the report is not legally binding on either party.

Nothing in this process prevents the customer from obtaining their own advice, contacting Consumer Affairs Victoria, applying to VCAT or exercising any other right or remedy available under applicable law.

Part Q: Australian Consumer Law

39. Your statutory rights

The benefits provided by this voluntary workmanship guarantee are in addition to other rights and remedies available to the consumer under law.

Nothing in this document excludes, restricts or modifies any right, remedy or consumer guarantee that cannot lawfully be excluded, restricted or modified.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

You are also entitled to choose a refund or replacement for major failures with goods.

If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

42. Entire voluntary guarantee

This document contains the terms of Aussie Painting's voluntary workmanship guarantee unless the customer's accepted written quote expressly states otherwise.

The accepted quote may:

Nothing in a quote or this document may exclude a right or remedy that cannot lawfully be excluded.
